Stay of Proceedings for police fabrication of evidence and false testimony
These are Justice Gray’s reasons for judgement in this case. He accepted that I had established that officers concocted a scheme to attribute evidence to my client that didn’t exist. Of particular note at para 173 is that he would have found this to be true on a criminal standard of proof beyond a reasonable doubt if he had been required to do so. Since the judgement has been released nothing has been said about any possible consequences for the officers.
