Tania Bariteau

Tania Bariteau is a partner at Derstine Bariteau, where she focuses on criminal litigation at both the trial and appellate levels. Tania is known for taking on the most serious and complex criminal cases, including serious indictable offences such as homicides, manslaughter, firearms, drug trafficking, human trafficking, and sexual assaults. She has built a reputation as a fearless advocate for clients facing the most challenging charges.

Tania has successfully defended clients in high-stakes homicide cases and has represented individuals at the Ontario Court of Justice and the Superior Court of Justice. Her expertise extends to jury trials, where she has secured successful verdicts and represented numerous clients who were acquitted after trial, showcasing her skill and unwavering dedication to achieving the best possible outcomes in even the most challenging and complex cases.

Bilingual in both official languages, Tania offers legal services in English and French, ensuring all clients receive the highest level of representation. She is committed to staying accessible to her clients, regularly visiting those in custody and making herself available for phone calls or meetings unless she is in court.

Tania obtained both her Licence en droit (LL.L) and Juris Doctorate (J.D.) from the University of Ottawa. During her studies, she served as the criminal division leader at the University of Ottawa Community Legal Clinic (UOCLC), where she successfully defended multiple clients at trial under the guidance of seasoned criminal lawyers. Tania's commitment to her work was recognized with the prestigious George-Brown Award for her exceptional dedication to both her clients and her profession.

Outside of her legal practice, Tania is a second-degree black belt in Taekwon-do, having competed at the International World Championships three times prior to law school. This discipline and focus is reflected in her approach to law, where she combines strategic thinking with perseverance and determination.

Recent Cases

R v. S.

Mr. S. was charged with conspiracy to import ketamine, importation of ketamine and possession for the purpose of trafficking ketamine. Counsel brought an Application under section 11(b) of the Charter of Rights and Freedoms for the delay taken by the Crown in prosecuting this case. After reviewing Tania’s application and factum, the Crown agreed to stay all charges against Mr. S. without the need of any oral argument in Court. All of Mr. S. charges were stayed (the functional equivalent of an acquittal).

R v. F.

Tania’s client was charged with possession for the purpose of trafficking of fentanyl. The fentanyl substance was mixed with heroine. Mr. F. was not aware that the heroine contained fentanyl.  At trial, Tania convinced the judge that Mr. F. did not have the requisite knowledge of the substance of the drugs to be convicted of possession for the purpose of trafficking of fentanyl. Tania’s client was acquitted at trial.

R v. G.

Tania’s client was charged with assault, possession of a dangerous weapon and theft (Mr. G. was initially charged with armed robbery and possession of a dangerous weapon but the Crown filed a new information on the first day of trial). At trial, Tania was able to point out the discrepancies in the different descriptions of the accused given by the witnesses in this case. Tania was also able to point out the flaws in the Crown’s case. As a result, Tania’s client was acquitted of all charges.

R v. C.

Tania’s client was charged with forcible entry and assault. The only evidence against Mr. C. was the testimony of the complainant. As such, the credibility of the complainant was the main factor in this case. In cross-examination, Tania was able to point out the flaws in the complainant’s story and demonstrate to the judge that she was not a credible witness resulting in Tania’s client was acquitted of all charges.
