Toronto Star Article on the Constitutional Challenge

Hussein Nur was finishing high school and working part-time when police caught him carrying a gun outside Driftwood Community Centre, near Jane St. and Finch Ave. W., in 2009.

Last November, he pleaded guilty to one count of possession of a loaded prohibited firearm, contrary to Section 95(1) of the Criminal Code.

Nur had no criminal record. The judge described him as someone with a supportive family and “considerable potential.” Now, rather than heading to university, Nur faced a mandatory minimum three-year sentence in a federal penitentiary.
